1. Acceptance of Terms
By accessing or using the Acre platform (the "Platform"), or by creating an account, accepting an invitation, or continuing to use Acre in any capacity, you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business entity, you represent that you have authority to bind that entity, and "you" refers to that entity throughout these Terms. The Platform is a business-to-business service intended solely for use by licensed hunting and fishing outfitters. It is not a consumer service. You must be at least 18 years of age to use the Platform. If you do not agree to these Terms, do not access or use the Platform.
2. Definitions

| "Invoice" | A payment request created by an Outfitter for a specific hunt or fishing trip, containing line items, deposit terms, hunt details, and a Payment Link. |
| "Payment Link" | A unique, tokenized URL generated per Invoice that allows a Client to pay a deposit or balance through Stripe Checkout. Payment Links may have expiration dates. |
| "Booking Request" | An unauthenticated trip inquiry submitted by a prospective hunter through an Outfitter's public booking page at /book/[slug]. |
| "Platform Fee" | The percentage of each payment transaction that Acre Access deducts as its service fee. Current rates: Starter Plan 3.99%; Pro Plan 1.49%. |
| "Connected Account" | An Outfitter's Stripe Express account linked to the Platform through which the Outfitter receives payouts. |
| "Stripe" | Stripe, Inc. and its affiliates, which provide payment processing infrastructure for the Platform. |
3. Description of Service
Acre Access, Inc. operates an invoicing and payment facilitation platform for hunting and fishing outfitters. The Platform enables Outfitters to:
- Create and send invoices for guided hunts and fishing trips;
- Collect deposit and final balance payments from Clients via tokenized Payment Links;
- Process post-trip adjustments and issue refunds;
- Manage Client contact records and booking requests;
- Access analytics on their transactions.
Acre Access, Inc. is a technology platform provider only. The following disclaimers apply without limitation:
- Acre Access, Inc. does NOT provide hunting, fishing, guide, or any outdoor recreation services.
- Acre Access, Inc. is NOT the outfitter, guide, trip operator, or a party to any booking between an Outfitter and a Client.
- Acre Access, Inc. does NOT guarantee, warrant, screen, vet, or endorse any Outfitter's qualifications, licensing, insurance, safety practices, or service quality.
- Acre Access, Inc. is NOT responsible for Outfitter licensing, regulatory compliance, land use permits, or insurance.
- Clients who submit Booking Requests are submitting inquiries directly to the Outfitter. Acre Access, Inc. is not a party to any resulting agreement.
4. Account Registration and Eligibility
4.1 Invite-Only Access
Outfitter accounts are not available through public self-registration. Accounts are created exclusively by Acre Access, Inc. administrators and activated via an emailed invitation link. Invitation links expire seven (7) days after issuance. If your invitation expires, contact Acre Access, Inc. at support@getacreaccess.com to request a new one.
4.2 Outfitter Representations
By activating an account and at all times during your use of the Platform, you represent and warrant that:
- You are a duly authorized representative of the Outfitter entity;
- All information you provide to Acre Access, Inc. is accurate, current, and complete;
- You hold all required federal, state, and local licenses, permits, and authorizations to operate as a hunting or fishing guide;
- You maintain adequate commercial general liability insurance for your operations;
- You will comply with all applicable fish and wildlife laws, including without limitation the Lacey Act, Migratory Bird Treaty Act, and applicable state hunting and fishing regulations;
- You will comply with all applicable land use permits, including USFS, BLM, and state land authorizations where applicable.
4.3 Stripe Account Requirement
Before you can receive payments through the Platform, you must complete onboarding of a Stripe Express Connected Account. Stripe's identity verification (KYC) requirements apply. Acre Access, Inc. does not independently verify Outfitter identity or banking information; that process is handled by Stripe.
4.4 Account Security
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify Acre Access, Inc. immediately at support@getacreaccess.com if you suspect unauthorized access.
5. Stripe Payment Processing
Payment processing services for Outfitters on Acre are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to operate as an Outfitter on Acre, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Acre Access, Inc. enabling payment processing services through Stripe, you agree to provide Acre Access, Inc. accurate and complete information about you and your business, and you authorize Acre Access, Inc. to share it and transaction information related to your use of the payment processing services provided by Stripe. Additional terms governing payment processing:
- Acre Access, Inc. does not store credit card numbers, CVV codes, or full payment card data. All card data is entered by Clients directly in Stripe's hosted checkout environment and is stored and secured by Stripe.
- Stripe handles all PCI DSS compliance obligations for card data. Acre Access, Inc. is not a cardholder data environment.
- Payouts to Outfitters' Connected Accounts are made by Stripe on their standard payout schedule, typically two (2) business days after a payment is received, subject to Stripe's policies.
- Acre Access, Inc. reserves the right to suspend payment processing access to an Outfitter's Connected Account in the event of elevated chargeback rates, suspected fraud, or other risk events, as described in Section 12.

6. Merchant of Record; Payments and Payouts
Acre Access, Inc. is the merchant of record for all payment transactions processed through the Platform. This means:
- Charges are originated on Acre Access, Inc.'s Stripe platform account. Stripe automatically transfers the net amount (total payment minus Platform Fee) to the Outfitter's Connected Account.
- Client card statements will reflect a charge from Acre Access, Inc. or a descriptor in the format "ACRE ACCESS* [OUTFITTER NAME]", not the Outfitter's individual business name.
- Refund and chargeback processing occurs through Acre Access, Inc.'s Stripe account. Clients receive 100% of the amount they paid on any refund. Outfitters bear financial responsibility for chargebacks arising from their services, as described in Section 8.
- Acre Access, Inc.'s role as merchant of record is a technical and operational designation related to payment processing. It does not make Acre Access, Inc. a party to the underlying booking agreement, nor does it impose any liability on Acre Access, Inc. for the quality, safety, or completion of Outfitter services.
7. Platform Fees and Subscription Plans
7.1 Current Fee Schedule

7.2 Fee Deduction
Platform Fees are deducted automatically at the time each payment is processed. Fees are calculated on the gross payment amount and applied separately to deposit payments and balance payments. The fee amount is recorded on each transaction.
7.3 Platform Fee Refunds
When a refund is issued on any transaction processed through the Platform, Acre Access, Inc. absorbs its own Platform Fee. Clients receive 100% of the amount they originally paid, regardless of the reason for the refund. Acre Access, Inc. does not pass its Platform Fee loss to Outfitters in connection with refunds. Note that Stripe's payment processing fees (approximately 2.9% + $0.30 per transaction) are not refunded by Stripe to any party when a refund is issued. This is a non-negotiable policy of Stripe, Inc. and is outside the control of Acre Access, Inc.
7.4 Pro Plan Subscription
The Pro plan is billed monthly at $199.00 through Stripe. Subscriptions auto-renew until cancelled. You may cancel at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period; no partial-month refunds are issued for subscription fees. Upon cancellation, your account reverts to the Starter plan and the Starter fee rate applies to subsequent transactions.
7.5 Fee Changes
Acre Access, Inc. reserves the right to modify Platform Fee percentages or subscription pricing upon thirty (30) days written notice by email to the address associated with your account. Continued use of the Platform after the effective date of a fee change constitutes acceptance of the new rates.
8. Invoices, Refunds, and Chargebacks
8.1 Invoice Lifecycle
Invoices created on the Platform progress through the following stages: Draft, Sent, Deposit Paid, Adjusted, Final Paid, Completed. An invoice may also be Cancelled or Refunded. Outfitters are responsible for the accuracy of all invoice content, including line items, pricing, dates, and Client information.
8.2 Two-Stage Payments
The Platform supports a two-stage payment structure: a deposit collected upfront and a balance due after the hunt or trip. Outfitters may also apply post-trip adjustments. Separate Stripe Checkout sessions are generated for deposit and balance payments; Platform Fees apply to each payment separately.
8.3 Outfitter Refund Policy
Outfitters set their own refund and cancellation policies with their Clients. Acre Access, Inc. does not impose a platform-wide refund policy governing the relationship between an Outfitter and its Clients. Outfitters are solely responsible for communicating their cancellation and refund terms to Clients prior to booking. Outfitters may initiate refunds through the Platform dashboard. When a refund is issued, the full amount paid by the Client is returned to their original payment method. Refunds are processed via Stripe and are subject to Stripe's processing timelines (typically 5-10 business days for the credit to appear on the Client's statement).
8.4 Chargebacks and Disputes
Because Acre Access, Inc. is the merchant of record, chargebacks filed by Clients are initiated against Acre Access, Inc.'s Stripe account. Outfitters agree to:
- Respond promptly to requests from Acre Access, Inc. for information or documentation to contest a chargeback;
- Provide copies of booking confirmations, liability waivers, communications, and any other evidence requested within the timeframe specified by Acre Access, Inc.;
- Bear financial responsibility for chargebacks and associated fees arising from their services, including without limitation chargeback dispute fees assessed by Stripe. If an Outfitter's chargeback rate exceeds acceptable thresholds (0.75% of transaction volume triggers a warning; 1.0% triggers account suspension), Acre Access, Inc. may suspend the Outfitter's ability to send new invoices until the dispute rate returns to acceptable levels. Acre Access, Inc. will provide written notice of suspension.
9. Booking Requests
Booking Requests are trip inquiries submitted by prospective Clients through an Outfitter's public booking page. The following terms apply:
- Submitting a Booking Request does NOT create a binding reservation, contract, or commitment by either party.
- Booking Requests collect: hunter name, email, phone, preferred dates, party size, target species, and notes. This information is transmitted to the Outfitter.
- Acre Access, Inc. is not a party to any booking or agreement resulting from a Booking Request.
- Outfitters may accept (by creating an invoice), decline, or not respond to Booking Requests. Acre Access, Inc. is not responsible for Outfitter responsiveness or the outcome of any Booking Request.
- By submitting a Booking Request, a prospective Client consents to Acre Access, Inc. storing their contact information and transmitting it to the Outfitter for the purpose of evaluating and responding to the inquiry.
10. Outfitter Obligations
In addition to all other obligations in these Terms, you agree to:
- Maintain all required federal, state, and local outfitter, guide, and fishing licenses, permits, and authorizations at all times while using the Platform;
- Comply with all applicable fish and wildlife laws and regulations, including federal laws (Lacey Act, Migratory Bird Treaty Act, Endangered Species Act) and applicable state hunting and fishing regulations;
- Comply with all applicable land use permits, including USFS, BLM, and state land authorizations, where applicable to your operations;
- Maintain adequate commercial general liability insurance for your operations and provide evidence of insurance to Acre Access, Inc. upon request;
- Provide accurate descriptions, pricing, availability, and terms in all invoices and booking materials;
- Honor invoices sent to Clients in good faith and provide the services described;
- Not use the Platform to process payments for any illegal activities, including unlicensed guiding, unlawful take of wildlife, or violations of any applicable law or regulation;
- Obtain legally compliant liability waivers, assumption of risk agreements, or other required documentation directly from Clients before commencing any hunt or trip (Acre Access, Inc. does not provide, collect, or verify waivers of any kind);
- Cooperate fully with Acre Access, Inc. in responding to chargebacks, disputes, and regulatory inquiries.
11. Liability Waivers and Assumption of Risk
Acre Access, Inc. does not provide, collect, store, verify, or have any involvement with liability waivers, assumption of risk agreements, or any similar documents. Outfitters are solely responsible for obtaining all legally compliant waivers and disclosures required under applicable law from their Clients prior to commencing any hunt, fishing trip, or outdoor activity. Hunting, fishing, and outdoor recreation activities involve inherent and serious risks, including but not limited to: firearm and archery hazards; wildlife encounters; watercraft and boating risks; adverse weather and environmental conditions; terrain and fall hazards; physical injury, property damage, and death. ACRE ACCESS, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ASSUME NO LIABILITY WHATSOEVER FOR ANY INJURY, PROPERTY DAMAGE, DEATH, OR OTHER HARM ARISING FROM ACTIVITIES BOOKED, PAID FOR, OR FACILITATED THROUGH THE PLATFORM.
12. Contacts, Client Data, and CRM
When an Outfitter creates an invoice, Acre Access, Inc. automatically creates or updates a contact record in that Outfitter's account containing the Client's name, email, phone, and aggregated invoice history. Contact records are accessible only to the Outfitter whose account generated them; they are not shared with other Outfitters or third parties (except as described in the Privacy Policy). Outfitters retain ownership of and responsibility for their Client relationship data. By using the Platform, you represent that you have obtained any required consent to store and use your Clients' contact information through a third-party platform. Upon termination of your account, you may export your invoice, contact, and booking data in a machine-readable format from within the Platform prior to account closure. Acre Access, Inc. will retain data as described in the Privacy Policy.
13. Intellectual Property
Acre Access, Inc. owns all right, title, and interest in and to the Platform, including all software, design, trademarks, and content created by Acre Access, Inc. These Terms do not grant you any rights in the Platform other than a limited, non-exclusive, non-transferable license to use it for its intended purpose during the term of your account. Outfitters retain ownership of their content: business names, logos, invoice text, and other materials submitted to the Platform. By submitting content, you grant Acre Access, Inc. a non-exclusive, royalty-free, worldwide license to display and transmit your content as necessary to deliver the Platform's services, including sending invoices and transactional emails to Clients on your behalf. You represent that your content does not infringe any third party's intellectual property rights.
14. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law, regulation, or ordinance;
- Process payments for unlicensed guiding, unlawful take of wildlife, or any illegal hunting or fishing activity;
- Misrepresent species availability, bag limits, hunting quotas, or other material booking terms;
- Facilitate violations of federal or state fish and wildlife regulations;
- Gain unauthorized access to the Platform or circumvent any security or access controls;
- Reverse engineer, decompile, or attempt to extract the Platform's source code;
- Scrape, harvest, or systematically extract data from the Platform;
- Introduce malware, viruses, or other harmful code;
- Interfere with the Platform's operation or other users' access to it.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (a) IN NO EVENT WILL ACRE ACCESS, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, EVEN IF ACRE ACCESS, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. (b) ACRE ACCESS, INC.'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE TOTAL PLATFORM FEES PAID BY YOU TO ACRE ACCESS, INC. IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. (c) ACRE ACCESS, INC. SPECIFICALLY DISCLAIMS ALL LIABILITY FOR: (i) PHYSICAL INJURY, PROPERTY DAMAGE, OR DEATH ARISING FROM ACTIVITIES BOOKED OR PAID FOR THROUGH THE PLATFORM; (ii) ANY ACT OR OMISSION OF AN OUTFITTER; (iii) SERVICE INTERRUPTIONS BY STRIPE, RESEND, SUPABASE, OR ANY OTHER THIRD-PARTY INFRASTRUCTURE PROVIDER; (iv) LOSS OR CORRUPTION OF DATA.

16. Indemnification
You agree to defend, indemnify, and hold harmless Acre Access, Inc. and its officers, directors, employees, agents, and successors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your Outfitter services, activities, and operations;
- Physical injury, property damage, or death arising from activities booked or paid for through the Platform;
- Your content, including any claim that your content infringes a third party's intellectual property rights;
- Your violation of these Terms or applicable law;
- Your failure to hold required licenses, permits, or insurance;
- Any chargebacks or payment disputes arising from your Client relationships;
- Your breach of any representation or warranty made in these Terms.
17. Warranties and Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ACRE ACCESS, INC. DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. Acre Access, Inc. does not warrant the accuracy, completeness, or fitness for purpose of any Outfitter's invoice content, service descriptions, or booking terms. Clients transact with Outfitters at their own risk.
18. Term, Termination, and Suspension
These Terms are effective upon your acceptance and continue until terminated. Either party may terminate these Terms with thirty (30) days' written notice. You may terminate by ceasing use of the Platform and providing written notice to support@getacreaccess.com. Acre Access, Inc. may suspend or immediately terminate your account without prior notice if:
- You engage in illegal activity or violate these Terms in a material respect;
- Stripe suspends or terminates your Connected Account;
- Your chargeback rate exceeds the suspension threshold described in Section 8.4;
- You provide false, inaccurate, or misleading information to Acre Access, Inc. or Stripe;
- Acre Access, Inc. determines, in its reasonable judgment, that continued access poses a risk to the Platform, other Outfitters, or Clients. Upon termination: (a) pending Stripe payouts already in process will continue through Stripe's standard payout cycle; (b) your access to the Platform will be revoked; (c) you may download your account data prior to account closure. The following sections survive termination: 6, 11, 13, 15, 16, 17, 19, and 21.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
19.2 Arbitration
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM THAT CANNOT BE RESOLVED INFORMALLY WILL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS COMMERCIAL ARBITRATION RULES. THE ARBITRATION WILL BE SEATED IN Comal County, Texas. JUDGMENT ON THE ARBITRATION AWARD MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION.
19.3 Class Action Waiver
YOU AND ACRE ACCESS, INC. EACH WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING IN CONNECTION WITH ANY DISPUTE UNDER THESE TERMS.
19.4 Jury Trial Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY WAIVES ITS RIGHT TO A JURY TRIAL IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS.
19.5 Informal Resolution
Before initiating arbitration, each party agrees to first attempt informal resolution by notifying the other party in writing and allowing thirty (30) days to resolve the dispute.

20. Modifications to Terms
Acre Access, Inc. reserves the right to modify these Terms at any time. For material changes, Acre Access, Inc. will provide at least thirty (30) days' prior notice by email to the address associated with your account. For non-material changes, Acre Access, Inc. may update these Terms without prior notice, and the "Last Updated" date at the top will reflect the change. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to a modification, your sole remedy is to terminate your account before the effective date.
21. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and Acre Access, Inc. regarding the Platform and supersede all prior agreements, representations, and understandings. Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. No Waiver. Failure by Acre Access, Inc. to enforce any provision of these Terms will not constitute a waiver of the right to enforce it in the future. Force Majeure. Acre Access, Inc. will not be liable for delays or failures in performance caused by events beyond its reasonable control, including natural disasters, acts of government, internet outages, or third-party service provider failures. Assignment. You may not assign your rights or obligations under these Terms without Acre Access, Inc.'s prior written consent. Acre Access, Inc. may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets. Notices. Notices to Acre Access, Inc. should be sent to support@getacreaccess.com. Notices from Acre Access, Inc. to you will be sent to the email address on your account. Contact.
